These Terms of Trade apply to all goods and services supplied by AUTOLEC LIMITED ("AUTOLEC", "we", "us" or "our") to our customers ("you" or "your").
By requesting, booking, authorising or accepting work from AUTOLEC, you agree to these Terms of Trade.
These Terms should be read together with any quotation, estimate, job approval, invoice or other written agreement provided to you. Where there is a specific written agreement that differs from these Terms, the specific agreement will apply to the extent of any inconsistency.
AUTOLEC provides mobile automotive electrical, diagnostic, air-conditioning, marine electrical and electrical installation services.
Our services may include:
Where requested, AUTOLEC may provide either a quotation or an estimate.
A quotation is a price for the specific work described and is subject to any conditions, exclusions or assumptions stated in the quotation.
An estimate is an indication of the expected cost based on the information available to us at the time and is not a fixed or guaranteed price.
The final cost may differ from an estimate where additional faults, damage, deterioration or other circumstances are discovered during diagnosis or repair.
This may include situations where:
Where reasonably practicable, we will discuss significant additional work with you and obtain your approval before proceeding.
Diagnostic and inspection work is chargeable whether or not you subsequently authorise any recommended repairs.
Electrical faults can be complex, intermittent or caused by multiple issues.
Diagnosis involves investigating the cause of a reported fault and does not guarantee that the fault will be identified within a particular amount of time or that the vehicle, vessel, machinery or equipment will ultimately be repairable.
Where the reported fault is caused by multiple issues, or where identifying or repairing one fault reveals another underlying fault, additional diagnostic or repair work may be required.
Completing a specifically authorised repair does not necessarily mean that all faults within the vehicle, electrical system or equipment have been identified or rectified.
Where a fault is intermittent or cannot be reproduced during testing, AUTOLEC cannot guarantee that the fault will be identified during a particular inspection or visit.
If you choose not to proceed with recommended repairs after diagnosis, all applicable diagnostic, inspection, labour and travel charges remain payable.
If additional work is identified after work has commenced, we will seek your approval where reasonably practicable.
Where additional work is reasonably necessary to safely continue, complete or protect the vehicle, vessel, machinery or equipment, and obtaining prior approval is not reasonably practicable, AUTOLEC may undertake reasonable additional work.
Any additional work authorised by you, or reasonably necessary in the circumstances, will be charged at our applicable rates.
Parts and materials may be supplied by AUTOLEC or, where agreed, supplied by you.
Parts and materials supplied by AUTOLEC will be charged at the price applicable to the job.
Some parts may be special-order, custom, non-returnable or require payment or a deposit before they are ordered.
If you request a particular brand, supplier or specification, this must be advised before the part is ordered.
If a required part becomes unavailable, is delayed by a supplier or cannot reasonably be sourced, we will advise you and discuss the available options.
Where you supply parts or components, you are responsible for ensuring that they are suitable for the intended application.
AUTOLEC may decline to install a part where we reasonably consider it to be unsuitable, defective, unsafe or incompatible.
To the extent permitted by law, AUTOLEC is not responsible for defects, incorrect specifications, incompatibility or failure of customer-supplied parts.
If a customer-supplied part is incorrect, defective or unsuitable and additional labour, time or parts are required as a result, those additional costs may be charged.
Vehicles, vessels, machinery and equipment may have existing electrical faults, deterioration, corrosion, non-standard wiring, previous repairs or modifications.
AUTOLEC is not responsible for faults, deterioration or damage that existed before we commenced work, except where caused or contributed to by AUTOLEC's own work, negligence or breach of an applicable legal obligation.
Older vehicles and equipment may contain electrical components, wiring, connectors or fittings that are already worn, brittle, corroded or otherwise weakened.
Accessing, testing, dismantling or removing such components may reveal additional faults or cause a previously weakened component to fail.
Where reasonably practicable, we will advise you if we identify a condition that may affect the work or require further repair.
Electrical systems can involve multiple interconnected components and control systems.
Unless specifically quoted otherwise, diagnostic charges cover the time, labour and equipment required to investigate the reported fault.
Finding and repairing one electrical fault does not necessarily mean that all other faults within the vehicle or system have been identified or repaired.
Where a fault is intermittent, cannot be reproduced, or requires specialist equipment, manufacturer information or further testing, additional diagnostic time may be required.
Where a vehicle, vessel or equipment has been modified, previously repaired, incorrectly wired or fitted with non-standard components, additional diagnostic time may be required.
Air-conditioning systems may have existing leaks, damaged components or other faults.
A regas, recharge or air-conditioning service does not guarantee that a system will remain operational where another fault or leak exists.
Where a leak or other fault is identified, AUTOLEC will advise you of any further work recommended.
Where reasonably necessary to diagnose, test or verify electrical work, AUTOLEC may need to drive or road test a customer's vehicle.
By authorising work that may reasonably require a road test, you authorise AUTOLEC and its authorised drivers to drive the vehicle for the purpose of carrying out, checking or verifying the work.
AUTOLEC will take reasonable care when driving and testing customer vehicles and will comply with applicable road rules and licensing requirements.
Road testing will only be undertaken where AUTOLEC reasonably considers it necessary for the work being carried out.
Where reasonably practicable, AUTOLEC will advise you if a road test is required.
If a customer vehicle is damaged during a road test, AUTOLEC will assess the circumstances and notify you of any incident as soon as reasonably practicable.
Nothing in these Terms of Trade limits any rights or remedies available to you under New Zealand law.
AUTOLEC provides a mobile service.
You must ensure that the vehicle, vessel, machinery or equipment is available and reasonably accessible at the agreed location and time.
The work location must be reasonably safe and suitable for the work being carried out.
You must advise AUTOLEC of any known hazards or conditions at the work location that may affect our ability to safely carry out the work.
Where we attend a location and cannot reasonably commence or complete the work because the vehicle or equipment is unavailable, inaccessible, unsafe or materially different from the information provided, AUTOLEC may charge for reasonable time and travel incurred.
Any completion time provided by AUTOLEC is an estimate unless a specific timeframe has been agreed in writing.
Completion times may be affected by circumstances outside our reasonable control, including:
We will endeavour to keep you informed where a significant delay occurs.
Unless otherwise agreed in writing, payment is due on completion of the work or by the due date stated on your invoice.
AUTOLEC may require payment or a deposit before ordering special-order parts or commencing certain work.
Where an account facility has been approved, the agreed account terms will apply.
Payment methods accepted by AUTOLEC may include those advised on your invoice or at the time of booking.
If an invoice remains unpaid after the due date, AUTOLEC may suspend further work or require payment before undertaking additional work.
AUTOLEC may recover reasonable costs incurred in recovering overdue amounts, to the extent permitted by law.
Where agreed with you or otherwise permitted by law, interest may be charged on overdue amounts.
Once we have notified you that your vehicle, vessel, machinery or equipment is ready for collection or return, you should arrange this within a reasonable timeframe.
Where property remains with AUTOLEC for an extended period after you have been notified that it is ready, reasonable storage charges may apply where these have been advised to you.
To the extent permitted by law, AUTOLEC retains any lawful rights it may have to retain possession of property where money is properly owing for work carried out or goods supplied.
To the extent permitted by law, ownership of parts or other goods supplied by AUTOLEC remains with AUTOLEC until those goods have been paid for in full.
Nothing in this clause affects any rights that cannot lawfully be excluded or modified.
AUTOLEC takes pride in the quality of its workmanship.
If you believe there is a problem with work carried out by AUTOLEC, please contact us as soon as reasonably practicable so that we can inspect and assess the issue.
Where a workmanship issue is identified, AUTOLEC will provide an appropriate remedy in accordance with our legal obligations.
Any specific warranty offered by AUTOLEC will be stated on the relevant quotation, invoice or other written agreement.
Unless otherwise stated, any warranty offered by AUTOLEC applies only to the work or parts to which it relates.
A warranty does not cover:
Manufacturer warranties applying to supplied parts will be subject to the manufacturer's terms and conditions.
Where a fault is believed to be related to AUTOLEC's work, you must give AUTOLEC a reasonable opportunity to inspect the vehicle, vessel or equipment and, where appropriate, remedy the issue before arranging repairs elsewhere, except where urgent action is reasonably necessary.
Nothing in this section limits any rights or remedies that cannot legally be excluded.
Nothing in these Terms of Trade is intended to exclude, restrict or modify any rights or remedies that cannot legally be excluded, restricted or modified.
Where the Consumer Guarantees Act 1993 (CGA) applies, your rights under the CGA remain unaffected.
Where both AUTOLEC and the customer are in trade, and the goods or services are acquired in trade, the parties may agree in writing that the Consumer Guarantees Act 1993 will not apply to the relevant transaction, provided the requirements of section 43 of the Act are satisfied.
Nothing in these Terms of Trade excludes or limits liability where doing so would be unlawful.
To the extent permitted by law, AUTOLEC is not responsible for loss or damage caused by:
This does not exclude or limit liability to the extent that the loss or damage was caused by AUTOLEC's own negligence, breach of contract or failure to meet an applicable legal obligation.
To the extent permitted by law, AUTOLEC will not be liable for indirect or consequential loss, including loss of use, loss of income, accommodation, alternative transport or other consequential expenses.
Nothing in this clause limits rights available to consumers under the Consumer Guarantees Act where that Act applies.
You are responsible for providing accurate information about the vehicle, vessel, machinery or equipment and advising AUTOLEC of any known faults, modifications, previous repairs or other circumstances that may affect the work.
You must provide reasonable access to the vehicle or equipment and disclose any known safety hazards.
You should remove valuable personal belongings from your vehicle or equipment before work commences.
AUTOLEC will take reasonable care of your property while carrying out our work, but is not responsible for personal belongings left in vehicles or equipment except where liability cannot lawfully be excluded.
We understand that circumstances change and ask that you provide as much notice as reasonably possible if an appointment needs to be cancelled or rescheduled.
Where an appointment is cancelled at short notice, or we attend a job that cannot proceed due to circumstances within the customer's control, AUTOLEC may charge for reasonable time, travel, parts or other costs already incurred.
If you have a concern about our workmanship, goods or service, please contact AUTOLEC as soon as reasonably practicable.
We will investigate the concern and, where appropriate, provide a reasonable opportunity to remedy the issue.
Where you believe a repair has not resolved the original fault, please contact us before arranging further work with another provider where reasonably practicable.
This gives AUTOLEC a reasonable opportunity to inspect the vehicle, vessel or equipment and determine the cause of the issue.
Nothing in this complaints process limits any rights available to you under New Zealand law.
AUTOLEC may collect and use customer information where reasonably necessary to:
Personal information will be handled in accordance with applicable New Zealand privacy legislation.
AUTOLEC is not responsible for delays caused by circumstances outside our reasonable control, including severe weather, natural disasters, accidents, supplier delays, parts shortages, industrial action, vehicle breakdowns or other unforeseen circumstances.
If any provision of these Terms of Trade is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
These Terms of Trade are governed by the laws of New Zealand.
These Terms of Trade may be updated from time to time. The version applicable to a particular job will generally be the version in effect when the work was authorised, unless otherwise agreed in writing.
